The following are a list of the main terms & conditions that apply. All parties making a booking with the Middleton Hunt for the Event or visiting the Event must accept the terms and conditions contained herein.

 

1.    Definitions

  1. The “Venue” is Birdsall Estate, Birdsall, Malton, YO17 9NU.

  2. The “Middleton Hunt” is an organization and is the Event organizer and its address is The Kennels, Birdsall, Malton, North Yorkshire, YO17 9NS; email address middletonclayday@gmail.com 

  3. The “Client” – The individual, company or other who has signed the booking form on behalf of the “Party”

  4. The “Party” – The individuals who will be attending the Venue and taking part in activities at the Venue. The Party will include four shooters only plus any other non-shooter guests.

  5. The “Visitors” – The individuals who attend the Venue but are neither the Client nor Party and will therefore not be entitled themselves to any of the benefits, goods or services pursuant to this agreement which are included within the Entry Fee. Visitors may include the guests of any Event Sponsors. Subject to the Event organizer and to availability at the Event the Visitors will be able to purchase refreshments and any other goods or services that might be offered.

  6. “You” means Client, Party and Visitors.

  7. The “Event” is the sporting clay pigeon shoot taking place on the   Saturday 3rd June 2023. The shooting activities are organised operated by the E J Churchill Group Limited on behalf of the Middleton Hunt. The shooting will

  8. The “Entry Fee” is £1200 per Party of four shooters plus £40 per additional individual non-shooter within that Party. Provided within that entry fee are:

    1. 5 x 100 ‘bird’ clay pigeon flurry stands with cartridges for the shooters; and

    2. breakfast, on course refreshments and lunch for each Party member (i.e including shooters).

  9. The “Deposit” is £300 per Party of four shooters and £10 per non-shooter within such Party all to be paid by the Client.

2.    Booking

  1. Bookings for the Event will be secured upon the receipt of the Deposit which is non refundable. Booking confirmations can be sent upon request. Booking forms can be downloaded from the internet at www.middletonclayday.co.uk

  2. Entry forms should be sent to MH Clay Day, Manor Farm, Broughton, Malton, North Yorkshire, YO17 6QJ or by email to middletonclayday@gmail.com

  3. The Entry Fee or balance thereof is payable in full prior to the event date.

  4. Save at the discretion of the Middleton Hunt no Party will be accepted to take part in any activity without payment in advance.

  5. The Middleton Hunt also reserves the right to the Entry Fee or balance thereof for any “no-show” if not notified in advance of 15 days of the Event.

  6. Bookings made within the 15 days of the specified date must be paid for in full at the time of the booking.

  7. Bookings will be confirmed and secured upon the receipt of a non refundable Entry fee.

3.    Payment

  1. Payment can be made by Cheque or BACS:

    1. Cheques made payable to: MHSC and sent to Manor Farm, Broughton, Malton, North Yorkshire, YO17 6QJ.

    2. BACS payments to: SORT CODE 40-13-27 | ACCOUNT NUMBER 71219626 | ACCOUNT NAME MHSC please reference your payment with your team name used on the booking form.

4.    Participation and Attendance

  1. By making a booking for the Event or attending the Event you accept these terms and conditions.

  2. Each Party shall need to provide their own 4x4 transport to move to and from each stand.

  3. The Event will commence and end at Birdsall House, Birdsall YO17 9NU. Each Party will need to register at the Secretary’s tent/desk before they are permitted to start shooting or attend any stands.

5.    Cancellations

  1. Upon cancellation or a reduction in numbers to the Party, the Deposit(s) paid is/are non-refundable.

  2. All cancellations / reductions in numbers to the Party should be notified as soon as possible by phone, mail or email to the Middleton Hunt.

  3. Any cancellations within 15 days of the activity date will result in the Client being held liable for the full cost of the Entry Fee or reduction.

  4. In the event of the Middleton Hunt having to cancel the Event due to unforeseen circumstances such as weather or safety issues, a full deposit will be refunded.

6.    Shotguns, cartridges and loading

  1. Only double barrel over and under or side by side shotguns are permitted for use at the event. No semi-automatic and pump-action shotguns are to be used

  2. The shotguns used must be 12 gauge or smaller.

  3. Shooters are to shoot with single guns only but are permitted to have loaders.

  4. Suitable cartridges in 12 and 20 gauge are provided under the Entry Fee but if shooter wish to use their own cartridges they must be fibre wadded and be in size 6 or smaller shot.

7.    Safety

  1. It is paramount that each Party and Visitors abide by the rules and regulations stated in the safety briefing.

  2. We reserve the right to cancel or change any activity for safety purposes.

  3. Any Party who does not comply with the rules stated herein or in any further safety briefing will be withdrawn from the Event without refund. This particularly refers to anyone who puts themselves and others at risk and where the behaviour of the Party does not adhere to the rules or safety briefing provided.

  4. It is your responsibility to ensure that you are both fit & capable to shoot. This includes things like:

    1. bringing your glasses with you if you require them for short sightedness, wearing the safety glasses & hearing protection;

    2. Not drinking alcohol, or having taken drugs, that may impair you co-ordination, or decision making processes prior to shooting.

  5. All uncertified shooters to be properly supervised, by an authorized person, throughout the shoot and receive instruction before any gun handling takes place. Such uncertified shooters must inform an Event marshal at each stand they shoot at that they are uncertified.

  6. All persons must wear eye and ear protection, and a hat when shooting or standing close by to an active shooting stand.

  7. The Middleton Hunt reserves the right to refuse participation to a Party they believe may at any material time in respect to the Event be under the influence or alcohol or drugs.

  8. A shotgun is dangerous, unless handled and loaded with safety in mind:

    1. Always treat a shotgun as loaded until proven otherwise; forgetfulness, assumption and miscommunication can result in an injury or a fatality.

    2. Always carry shotguns empty and open, preferably, over the arm.

    3. An empty shotgun should only be closed when putting it in a case, rack or slip. These are the only times when even an unloaded shotgun should be closed.

    4. Muzzle awareness – never point a shotgun, not even an unloaded one, towards another person. Other people have no way of knowing if the gun is loaded or not. Your fellow shooters should not be subjected to the potential of having an accidentally loaded gun pointed towards them.

    5. Never mix different gauge cartridges in your pockets or cartridge bag.

    6. Before you load a shotgun, look through the barrels and check that they are unobstructed.

    7. If the shotgun misfires, point the muzzle down the range and wait 25 seconds before opening it.

    8. Always check that barrels are clear after a soft or unusual discharge.

    9. Never leave a shotgun leaning against a tree, wall or fence.

    10. Never leave a shotgun unattended at the Event.

    11. Never load a shotgun until you’re on the stand or in the safety cage, an obvious safety requirement to prevent danger to bystanders and accidental discharge in the direction of others.

    12. Never close a shotgun until it’s your turn to shoot and you are ready.

    13. Never turn towards other people with a loaded shotgun or when closing the shotgun.

    14. Always point a loaded shotgun down the range.

    15. If the stand has no shooting enclosure, take care not to swing the shotgun around towards people.

    16. The gun must be opened and emptied before stepping off the stand.

    17. Where shooters stand in a line with other shooters cartridges are to be loaded and unloaded upon the marshal’s command, e.g. “line ready”, “load” and “unload”.

    18. If there is a problem (other than a misfire), or if a “No Target” is called, open the shotgun. If you have to clear a shotgun, shoot down range, not at the ground or near the trap house.

    19. Open and unload the shotgun before leaving a stand or when moving between stands.

8.    General

  1. Clay Pigeon shooting is an outdoor activity, that is participated in, right through the year. For your best enjoyment you should wear suitable clothing for the time of year. You will be outdoors, away from any shelter for possibly several hours, so shower proof clothing, umbrellas, and waterproof foot wear, etc are all essential. We recommend a hat or cap, to both shield your head from bits of the broken targets & to keep the sun from your eyes. Loose upper body clothing such a "Puffa Jackets" are not advised for shooter due to getting caught on the gun, when putting in to your shoulder.

  2. The Middleton Hunt accepts no liability for loss or damage during any activity.

  3. Whilst every effort is made by the Middleton Hunt to control advertisements and any prize descriptions or prize fund payouts (if any), there will always be the opportunity for errors and omissions to get through the extensive checking systems that have been put in place. For this reason all web and published details are subject to change, and are subject to the exclusion of errors and omissions, as governed by English  Law.

  4. The Middleton Hunt will not post out prizes at any time. Any prizes are kept and are available for a whole twelve months from the date of the Event, at which time they are no longer available, and revert to the Middleton Hunt or any prize donor.

  5. The Middleton Hunt reserve the right to take photographs during and after the Event for their records and promotional purposes. All persons in entering our site agree to this, unless expressing a wish to the contrary, in writing to the Middleton Hunt, prior to the start of the Event.

9.    Disclaimers & Insurance

  1. A disclaimer must be signed prior to participating in any shooting activities. It is paramount that participants recognise that there is an element of risk associated with shooting. Whilst every care and attention is taken to ensure participants’ safety each Party will have to sign a disclaimer stating that they accept that there are risks involved in these activities and that they accept no liability against the Middleton Hunt in the circumstance of an accident during the Event. Nothing in this disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this disclaimer will exclude or limit The Middleton Hunt’s liability in respect of any:

    1. death or personal injury caused by Middleton Hunt’s negligence;

    2. fraud or fraudulent misrepresentation on the part of the Middleton Hunt; or

    3. matter which it would be illegal or unlawful for the Middleton Hunt to exclude or limit, or to attempt or purport to exclude or limit, its liability.

  2. Whilst not mandatory it is advisable that you arrange your own personal injury insurance.

10.    Limitations of liability

  1. The Middleton Hunt will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation breaches of these terms and conditions or to the contents of, or use of, or otherwise in connection with, the website www.middletonclayday.co.uk:

    1. to the extent that the website is provided free-of-charge, for any direct loss;

    2. for any indirect, special or consequential loss; or

    3. for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

    4. These limitations of liability apply even if the Middleton Hunt has been expressly advised of the potential loss.

  2. For the purposes of the Occupiers Liability Act 1957 or 1984 and in respect to any other statutory or common law claim that you might bring in respect to your use of the land the Event takes place upon and in connection to your attendance thereat you agree that you will only claim against the Middleton Hunt and/orE J Churchill Group Limited and not Birdsall Estates Company Ltd..

11.    No warranties

  1. The Middleton Hunt makes no representations or warranties in relation to the content of the website www.middletonclayday.co.uk  or the information and materials provided within these terms and conditions.

12.    Reasonableness

  1. You agree that the exclusions and limitations of liability set out in this disclaimer are reasonable.

  2. If you do not think they are reasonable, you must not participate in or attend the Event.

13.    Unenforceable provisions

  1. If any provision of these terms and conditions is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this website disclaimer.

14.    Indemnity

  1. You hereby indemnify the Middleton Hunt and undertake to keep the Middleton Hunt indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by the Middleton Hunt to a third party in settlement of a claim or dispute on the advice of Middleton Hunt’s legal advisers) incurred or suffered by the Middleton Hunt arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.

15.    Breaches of these terms and conditions

  1. Without prejudice to the Middleton Hunt’s other rights under these terms and conditions, if you breach these terms and conditions in any way, the Middleton Hunt may take such action as the Middleton Hunt deems appropriate to deal with the breach, including prohibitingor suspending your access to the Event, and/or bringing court proceedings against you.

16.    Variation

  1. The Middleton Hunt may revise these terms and conditions from time-to-time.  Revised terms and conditions will on the internet at www.middletonclayday.co.uk .  Please check this website regularly to ensure you are familiar with the current version.

17.    Assignment

  1. The Middleton Hunt may transfer, sub-contract or otherwise deal with the Middleton Hunt’s rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.

You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.
